We do not sell, trade, rent, lease, or loan personal information about you to any third party. The information you provide is used to process your order, make contact if we have questions about your order, and to assist us in making your overall experience with us the best it can be. At times, we will use your contact information to alert you to specific product information or marketing opportunities. Should you wish to not receive such communications from us, please feel free to contact us and we will immediately remove your name from such communications.

Purchase Agreement:

By purchasing a TommiSea product, you understand and assume complete responsibility and risk for: - Reading, understanding and following all instructions, warnings, cautions and safety information. If the item is to be used by a minor, it is the adult’s responsibility to ensure these guidelines are understood. - Proper assembly, service and maintenance of all items by an adult. In addition, you are instructed to utilize a trained, professional bicycle technician as necessary, to ensure all items are in proper working order before use. - The need to wear all of the appropriate protective safety gear and clothing while using the item(s). By making purchases on this website, you understand that there are certain risks involved with building and riding bicycles. These risks include, but are not limited to, serious injury and/or death. You freely agree that the use of the items sold herein is undertaken at your sole risk, and that TommiSea Bicycles, it's manufacturers, and its distributors shall not be liable for any claims for personal injuries, wrongful death or damages (including property damages), in any way, arising out of or connected to your use or anyone else's use of the aforementioned products, or the negligence of TommiSea Bicycles, its manufacturers, and/or its distributors. You freely agree to assume full responsibilities for the risks involved.

Important Safety Guidelines:

By purchasing a TommiSea Bicycles product, you agree to abide by the following safety guidelines:

SAFETY FEATURES - Keep in mind that the nature of lightweight, special purpose and custom bike building may exclude some safety features typically found on pre-assembled, mass market bicycles (i.e. reflectors). While most customers believe omission of these items enhances the design and functionality of their bicycle, be advised that we do offer these items for sale if they are not included in your initial purchase. TommiSea Bicycles is not responsible for any accidents or injuries that occur as a result of your decision to include or not include these items in your custom build.

RIDING - Due to their unique shape and size, TommiSea Bicycles do not handle like other types of bicycles. Please make sure to familiarize yourself with your bicycle, how it works and practice riding it in a safe area away from traffic or distractions before taking it out on busy streets. Always wear an approved helmet and safety gear while riding and obey traffic signs and laws. And when travelling off road be sure to familiarize yourself with your surroundings as trail, sand and snow riding can present risks typically not found in street bicycle riding.

ASSEMBLY - While some assembly may have occurred prior to shipping please keep in mind that all of the assembly should be carefully checked prior to riding. Although assembly for most bikes only requires a basic mechanical skill level and a limited number of fairly common tools, there are certain aspects of bike assembly that are critical to making your bike function properly and operate safely. Please be sure to consult a trained bicycle professional if you have any questions or concerns about properly assembling your new bike.

Payment Methods Accepted:

TommiSea Bicycles accepts the following forms of payment: - Credit Cards - Visa, Mastercard, American Express and Discover - Paypal - Your will automatically be linked to the Paypal payment website during checkout if you choose this option - Money Orders - Domestic Only please - Bank or Cashiers Checks - Personal Checks - Returned check fee is $25 - Cash (although sending cash through the mail is not advised) Although rare, the final cost billed may be slightly different from that illustrated on your online invoice due to impact of applicable taxes or updated shipping costs (typically applicable to larger/heavier items).

Sales Tax:

Florida residents will be charged 6% sales tax. These tax rates are subject to change as applicable.

Local Pickup:

If you are located near our Deerfield Beach, Florida warehouse you may now save shipping charges and pickup your order. Simply check the box on checkout. Please allow ample time for order processing and preparation before you come in to pick up your order. Calling to ensure your order is ready is advised. Orders may be picked up normal business hours - please call for times.

Shipping:

We do our best to ship your order within 48 hours of receipt (not including weekends). All outgoing orders will be shipped by either U.P.S. ground, FedEx ground or U.S.P.S. priority mail at our discretion, unless special instructions are provided. Please note that we require a street address for all shipments - no P.O. Boxes please.

The delivery of your order may take from one to seven business days, or more depending on your location. Shipping on or near holidays may also add time to delivery. We endeavor to keep all of our items in stock and ready to ship, however, inventory on hand may vary. On rare occasions, even when an item is shown on our website as in stock, some items ordered may not be available.

Backorders:

Sorry but due to the volume of orders we get we do not accept backorders. All merchandise is shipped directly from our East Coast warehouse. If an item you requested is out of stock, your order will ship without it, you will not be charged for it and it will not be backordered.

Returns:

All items may be returned for an exchange or replacement, provided they are done so within 15 days of receipt and returned in their original, saleable packaging. Sale items are final sale unless otherwise noted. Please call our customer service department to request an RMA (return merchandise authorization) number. Also, please include your contact information or a copy of your original order inside the box. This will help us properly credit your return. When sending back shipments, return freight charges are the customer's responsibility and non-reimbursable (unless of course it was our error). No merchandise returned after 15 days will be accepted unless goods are defective or shipped in error. All returns are subject to an inspection upon return to the warehouse. Items returned with open or unsaleable packaging are subject to a 15% re-stocking/re-packaging fee. In case of defective merchandise we reserve the right to credit or replace that item at our discretion.

Damaged Goods:

Products damaged in transit must be reported to the carrier immediately upon receipt. You are advised to save all packing lists, shipping cartons, and packing material the carrier has completed their review of the situation. We will do everything possible to speed the process to get you a replacement or credit.

Shortages:

All credits and claims for shortages must be reported to our customer service department within one business day. Before calling, make sure you open and thoroughly inspect all cartons and packing materials and tell us how many cartons you received. Also, please make sure you count the amount of packages you receive before you sign for them.

Deerfield Beach, Florida unless otherwise noted. Items can be withdrawn from sales at anytime. We are not responsible for typographical errors.
